This Privacy Policy explains how Afriskaut Inc. (“Afriskaut”, “we”, “us” or “our”) collects, uses, shares and protects personal data in connection with our scouting and player intelligence platform and related services (the “Platform” and “Services”). It applies to our website at www.afriskaut.com, the Platform, and any related communications.

Afriskaut is a sports recruitment intelligence and data analytics company. We identify, profile and present football talent to professional and semi professional clubs, agencies and other football stakeholders. Because of the nature of our business, we process two broad categories of personal data: (i) data relating to the users of our Platform, and (ii) data relating to the football players whose profiles appear on the Platform. This Policy addresses both.

Please read this Policy alongside our Platform Terms of Use. If you do not agree with this Policy, please do not use the Platform.

1. Who we are and how to contact us

Where required by law, we will designate a representative or data protection contact for individuals located in the European Economic Area (EEA) or the United Kingdom. Those details will be published here once designated.

2. The personal data we collect

Platform users (clubs, agencies, scouts, sporting directors and their personnel):

  • Identity and contact data — name, job title, organisation, email address, telephone number.
  • Account data — login credentials, account settings and preferences.
  • Transaction and billing data — subscription details, billing contact, and payment information (processed by our payment provider; see Section 7).
  • Usage data — how you interact with the Platform, including searches, profiles viewed, features used, device and browser information, IP address and log data.
  • Communications — correspondence with us, including support requests and enquiries.

Player data subjects (players profiled on the Platform):

  • Identity data — name, date of birth, nationality, and where relevant passport or identification details provided by the player, their club or academy.
  • Sporting and performance data — position, statistics, performance metrics, scouting reports, match and training footage, and analytical assessments.
  • Career data — current and former clubs, contract status where lawfully provided, and representation status.

Player profiles are typically provided to us by clubs, academies or authorised intermediaries, or compiled from information that is lawfully available. Players are generally not the users who register for the Platform. Section 5 explains the legal bases on which we process player data.

3. How we use personal data

We use personal data to:

  • Provide, operate and maintain the Platform and Services.
  • Create, host and present player profiles to authorised users for scouting and recruitment purposes.
  • Manage user accounts, subscriptions, invoicing and payments.
  • Communicate with users about the Services, including service updates and support.
  • Improve, develop and secure the Platform, including analytics and troubleshooting.
  • Comply with legal, regulatory and football governing body obligations, including record keeping.
  • Establish, exercise or defend legal claims, and prevent fraud or misuse.

4. Children and minors

The Platform is intended for use by professional football stakeholders and is not directed at children. We do not knowingly allow individuals under the age of 18 to register as Platform users.

We recognise, however, that some player profiles may relate to individuals who are under the age of 18. We treat data relating to minors with heightened care. In particular:

  • We only process minor player data where there is a lawful basis to do so and, where required, appropriate consent from a parent, legal guardian, club or academy with authority to provide it.
  • We limit the data we hold on minors to what is necessary for legitimate scouting and recruitment purposes.
  • We do not knowingly use minor data for any purpose that could facilitate harm, and we apply additional safeguards around access and retention.
  • We comply with the FIFA Regulations on the Status and Transfer of Players, including the rules protecting minors, and with applicable data protection law relating to children.

If you believe we hold data relating to a minor without an appropriate lawful basis, contact us at hello@afriskaut.com and we will review and, where appropriate, remove it promptly.

5. Legal bases for processing (EEA and UK users)

Where the EU or UK General Data Protection Regulation applies, we rely on the following legal bases:

  • Contract — to provide the Services to users who have entered into an agreement with us.
  • Legitimate interests — to operate, improve and secure the Platform, to present player profiles to authorised users for recruitment purposes, and to grow our business, provided such interests are not overridden by the rights of the individuals concerned.
  • Consent — where required, for example for certain minor player data or for optional communications. Consent may be withdrawn at any time.
  • Legal obligation — to comply with applicable laws and football regulatory requirements.

Where we rely on legitimate interests to process player performance and profile data, we have assessed that this is a proportionate use of professional sporting information for the purpose of connecting talent with clubs. Players may object to this processing as described in Section 9.

6. How we share personal data

We share personal data with:

  • Authorised Platform users — player profiles are made available to clubs, agencies and other vetted users for scouting and recruitment purposes.
  • Service providers and processors — hosting, cloud storage, payment processing, analytics, and communication tools that act on our instructions under appropriate data protection terms.
  • Professional advisers — lawyers, accountants and auditors where necessary.
  • Football governing bodies and authorities — where required by regulation or law.
  • Business transfers — in connection with a merger, acquisition, financing or sale of assets, subject to appropriate confidentiality protections.

We do not sell personal data. Our key service providers include cloud hosting, payment processing, email and analytics tools that act on our instructions under appropriate data protection terms.

7. Payments

Payments made through or in connection with the Platform are processed by third party payment providers. We do not store full payment card details on our own systems. The relevant provider’s handling of your data is governed by its own privacy policy.

8. International transfers

Afriskaut is based in the United States and works with clubs, players and partners across Africa, Europe and elsewhere. Personal data may therefore be transferred to, and processed in, countries other than the one in which it was collected, including the United States.

Where we transfer personal data from the EEA or UK to a country not recognised as providing an adequate level of protection, we put in place appropriate safeguards, such as the European Commission’s Standard Contractual Clauses and the UK International Data Transfer Addendum, or another lawful transfer mechanism.

9. Your rights

Depending on your location, you may have some or all of the following rights in relation to your personal data:

  • Access — to request a copy of the personal data we hold about you.
  • Rectification — to have inaccurate or incomplete data corrected.
  • Erasure — to request deletion of your data in certain circumstances.
  • Restriction and objection — to restrict or object to certain processing, including processing based on legitimate interests.
  • Portability — to receive certain data in a portable format.
  • Withdraw consent — where processing is based on consent.
  • Complain — to a supervisory authority (in the EEA or UK) or other applicable regulator.

For players whose profiles appear on the Platform: you may request access to, correction of, or removal of your profile by contacting us at hello@afriskaut.com. We will respond in accordance with applicable law.

Residents of certain US states (for example California) may have additional rights, including the right to know what personal information we collect and to request its deletion, and the right not to be discriminated against for exercising those rights. We do not sell personal information.

10. Data retention

We keep personal data only for as long as necessary for the purposes set out in this Policy, including to provide the Services, comply with legal and football regulatory obligations, resolve disputes and enforce our agreements. Retention periods vary depending on the type of data and the purpose for which it is held. When data is no longer needed, we delete or anonymise it.

11. Security

We implement appropriate technical and organisational measures to protect personal data against unauthorised access, loss, misuse or alteration. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security. Access to player data, particularly data relating to minors, is restricted to authorised users and personnel.

12. Cookies and analytics

The Platform and website may use cookies and similar technologies to operate, secure and improve the Services and to understand how they are used. Where required by law, we will obtain consent for non essential cookies. You can manage preferences through your browser settings.

13. Changes to this Policy

We may update this Policy from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Platform after an update constitutes acceptance of the revised Policy.
